Terms of Service

Article 1 – Definitions

In these general terms and conditions, the following terms are understood to mean:

  • Entrepreneur: Cho Persona, the natural or legal person who offers products and/or services at a distance to consumers.
  • Consumer: the natural person who does not act in the exercise of a profession or business and enters into a distance contract with the entrepreneur.
  • Distance contract: a contract in which, within the framework of a system for distance selling of products and/or services organized by the entrepreneur, only one or more techniques for distance communication are used up to and including the conclusion of the contract.
  • Right of withdrawal: the consumer's right to withdraw from the distance contract within the cooling-off period.
  • Cooling-off period: the period within which the consumer can exercise their right of withdrawal.

Article 2 – Applicability

These general terms and conditions apply to every offer by the entrepreneur and to every distance contract concluded between entrepreneur and consumer. Deviations from these terms and conditions are only valid if expressly agreed in writing.

Article 3 – The Offer

If an offer has a limited validity period or is subject to conditions, this is explicitly stated in the offer. The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to enable the consumer to make a proper assessment of the offer. Obvious mistakes or errors in the offer do not bind the entrepreneur.

Article 4 – The Contract

The contract is concluded at the moment the consumer accepts the offer and meets the conditions attached to it. The entrepreneur immediately confirms receipt of the acceptance of the offer electronically. As long as receipt of this acceptance has not been confirmed, the consumer may terminate the contract.

Article 5 – Prices

During the validity period stated in the offer, the prices of the offered products and/or services will not be increased, except for price changes resulting from changes in VAT rates. All prices include VAT unless stated otherwise. The entrepreneur is entitled to make price changes but will inform the consumer in a timely manner.

Article 6 – Delivery and Performance

The entrepreneur will exercise the greatest possible care when receiving and executing product orders. The delivery address is the address provided by the consumer to the entrepreneur. The entrepreneur aims to execute accepted orders promptly but no later than 30 days, unless a different delivery period has been agreed. If delivery is delayed or if an order cannot be executed in full or in part, the consumer will be notified no later than 30 days after placing the order. In that case, the consumer has the right to terminate the contract without costs.

Article 7 – Payment

Unless otherwise provided in the contract or additional terms, amounts owed by the consumer must be paid within 14 days after the cooling-off period begins, or if there is no cooling-off period, within 14 days after the contract is concluded. The consumer is obliged to immediately notify the entrepreneur of any inaccuracies in provided or stated payment details.

Article 8 – Right of Withdrawal

The consumer may terminate a contract for the purchase of a product during a cooling-off period of at least 14 days without giving any reason. The entrepreneur may ask the consumer for the reason for withdrawal but may not require them to provide their reason(s).

The cooling-off period begins on the day the consumer, or a third party designated in advance by the consumer who is not the carrier, receives the product.

During the cooling-off period, the consumer will handle the product and packaging with care. They will only unpack or use the product to the extent necessary to determine its nature, characteristics, and functioning. The principle is that the consumer may only handle and inspect the product as they would be permitted to do in a store.

Article 9 – Consumer Obligations During the Cooling-off Period

During the cooling-off period, the consumer will handle the product and packaging with care. The consumer is liable for any diminution in value of the product resulting from handling that goes beyond what is permitted in Article 8.

Article 10 – Exercise of the Right of Withdrawal and Associated Costs

If the consumer exercises their right of withdrawal, they notify the entrepreneur within the cooling-off period using the model withdrawal form or in another unambiguous manner. The consumer returns the product or hands it over to the entrepreneur (or their representative) promptly but in any case within 14 days from the day following the notification referred to in Article 8. The consumer bears the direct costs of returning the product, unless the entrepreneur has indicated they will cover these costs.

Article 11 – Liability

The entrepreneur is not liable for damage arising from the use of delivered products, unless there is intent or gross negligence on the part of the entrepreneur. The entrepreneur's liability is in any case limited to the amount paid out by their insurer or to the invoice amount of the relevant order.

Article 12 – Complaints Procedure

The entrepreneur has a properly publicized complaints procedure and handles complaints in accordance with this procedure. Complaints about the performance of the contract must be submitted to the entrepreneur in full and clear detail within a reasonable time after the consumer has discovered the defects. Complaints submitted to the entrepreneur will be answered within 14 days from the date of receipt.

Article 13 – Privacy

The entrepreneur respects the privacy of all users of their website and ensures that personal information you provide is treated confidentially. Processing of personal data is carried out in accordance with the General Data Protection Regulation (GDPR). For more information, please refer to our privacy policy.

Article 14 – Applicable Law and Jurisdiction

Contracts between the entrepreneur and the consumer to which these general terms and conditions apply are governed exclusively by Dutch law. Disputes will be submitted to the competent court in the Netherlands.
